Terms
The rules for bidding on a sponsor spot, in plain English. Every bid on this site is placed on these terms.

“I” and “me” on this site and in these terms mean SnowLabs UG (haftungsbeschränkt), Zur Frankenfurt 69, 60529 Frankfurt am Main, Germany, the company that runs Brand My Fold. “You” means the business placing the bid.
1. Business bidders only
Spots are advertising space sold to businesses and professionals, not to consumers. By bidding you confirm that you act in the course of your trade, business or profession (Unternehmer, § 14 BGB). Consumer rules, including the right of withdrawal for distance contracts, do not apply. Your own terms and conditions do not become part of the contract, even if I do not object to them separately.
2. What you are bidding on
One device: the one I buy and use as my everyday phone. Seven spots on it are for sale:
- Six sticker spots on the back. For each, I print your logo as a die-cut vinyl sticker and apply it in the position and at roughly the size shown on the site. The sticker stays on for at least 12 months from the day it goes on, for as long as I keep using the device as my daily phone. After that I may remove it.
- The cover-screen wallpaper. Your artwork runs as the wallpaper of the outer display for 6 consecutive months, starting once the device is in my hands and your artwork is on it.
Every winner also gets a listing on this site, with name, logo and a link to your website (marked as sponsored), for as long as the site is online.
The device, its name, price, colour and exact dimensions are estimates made before Apple’s announcement (see section 10). A spot is a paid placement, not an endorsement, and this project is not affiliated with, endorsed by or sponsored by Apple Inc.
3. How the auction works
- Each spot is its own auction with its own floor price. The first bid must be at least the floor; every later bid must be at least €10 above the current top bid. The site always shows the minimum you can bid.
- Every bid takes a deposit of 20% of the bid amount, at least €10, rounded up to whole euros, charged to your card immediately.
- A bid counts only once Stripe has confirmed the deposit. Until then it is not shown and cannot win.
- Confirmed payments are processed in the order Stripe reports them. If a higher bid on the same spot is confirmed moments before yours, yours does not become the top bid and your deposit is refunded automatically.
- The closing time is shown on the site. Because Apple has not announced its pre-order window, I may move it. If I do, everyone with a live bid is told by email, and nobody loses a spot because of the change. If a payment you started before the close is only confirmed after it, I decide whether to count it; if I do not, the deposit is refunded in full.
- When the auction closes, the highest confirmed bid on each spot wins, subject to section 5.
- All amounts are in euro and are charged in euro. Amounts shown in US dollars are an indicative conversion only.
4. Your bid is binding
Each bid is a binding offer to buy that spot at the amount you bid, on these terms. You cannot withdraw it. It lapses when someone outbids you or when I reject it; in both cases your deposit comes back in full. You can raise your own top bid at any time: the new deposit is charged and the old one refunded automatically.
The contract for a spot comes into being when I accept your winning bid by sending you the payment request described in section 6. This is not an auction in the sense of § 156 BGB; there is no auctioneer and no hammer.
5. Approval, and the right to say no
I look at every sponsor and every logo myself before it appears on the site, and I alone decide what goes on my phone. I may refuse or remove any bid or sponsor at any time, before or after the close, for any reason and without having to give one. If I do, you get back everything you have paid for that spot, and neither of us has any further claim.
To save us both time, I will not accept: anything unlawful or infringing someone else’s rights; pornographic, violent, hateful or discriminatory content; political parties and campaigns, and religious proselytising; tobacco and nicotine products, weapons, gambling and adult services; and anything I would not want to hold up in a meeting.
6. Winning, and paying the rest
After the close I email each winner a payment request for the remaining 80% of the bid, plus VAT where section 7 says so, together with the invoice. Your deposit counts towards the total. The balance is due within 14 days of the request.
If you do not pay in time, I may set you a short final deadline. If that passes too, I may withdraw from the contract and offer the spot to the next-highest bidder or re-open it. In that case I may keep your deposit as a lump-sum compensation for my costs and lost revenue. You are free to prove that my loss was lower, or that there was none; I remain free to claim a higher loss that I can prove.
7. Prices and VAT
All prices are net. German VAT, currently 19%, is added where German law requires it, in particular for sponsors based in Germany. For sponsors in another EU member state with a valid VAT ID the reverse-charge procedure applies and you account for the VAT in your own country (Art. 196 VAT Directive, § 13b UStG). Sponsors outside the EU are normally not charged German VAT. You are responsible for the accuracy of the VAT ID and the details you give me; if a VAT ID turns out to be invalid, I may charge the VAT afterwards.
8. Your logo and artwork
Delivery. With the payment request I ask you for print-ready artwork: a vector logo (SVG or PDF) for a sticker spot; for the wallpaper spot the full artwork at 1422 × 2088 pixels, or a logo plus a background choice that I set for you and show you before it goes on. If I have no usable artwork 30 days after asking, I print from the file you uploaded with your bid. If that is not usable either, the spot stays yours and the price stays due, but the sticker only goes on once I have artwork I can use.
Reproduction. I reproduce your artwork as faithfully as vinyl printing and the device allow. Small deviations in colour, size and position are not defects.
Your rights in it. You warrant that you own, or are licensed to use, the logo and artwork you supply, and that using them as described breaks no law and no third-party right. If a third party makes a claim against me because of your artwork, you indemnify me against that claim and the reasonable cost of defending it, unless you are not at fault.
Licence to me. You grant me a non-exclusive, worldwide, royalty-free licence to reproduce your logo and artwork for this project: on the device, on this site, and in photos and videos of the device that I publish during and after the project, including on social media and in the press. For material already published, that licence outlasts the term of your spot.
9. What I promise, and what I do not
- I buy the device at retail as soon as I can get one (section 10), print and apply the stickers myself and at my expense, set the wallpaper for its 6 months, and post photos once everything is on.
- I use the device as my everyday phone. Stickers wear. If a sticker is damaged or comes off during its term, I reprint and re-apply it once at my expense.
- I make no promise about impressions, reach, views, clicks, mentions, press coverage or where the phone goes. You are buying advertising space, not results.
- I keep the site online with reasonable care but do not guarantee its availability.
10. If I cannot get the device, or it is different
First supply is expected to be limited. If I have not obtained the device by 31 October 2026, I refund every winner in full, the deposit and anything paid on top, and the contract ends. Neither of us has any further claim.
Everything on this site about the device is a best guess made before the reveal. If the real device differs in shape or size so that a spot must change, I adjust the sticker to fit and agree the new size with you before anything is printed. Your spot, its position and your price stay as they are. If a spot cannot exist on the real device at all, you choose between a comparable spot and a full refund. Differences in model name, colour, storage or price alone do not affect your spot.
11. If the device is lost, stolen, broken or replaced
I move your sticker or wallpaper onto the replacement device, same spot, reprinted at my expense, within a reasonable time. If that is not possible, or I do not replace the device, I refund the price pro rata for the unused part of the 12-month sticker term or of the 6-month wallpaper term. Neither of us has any further claim.
12. Early removal
I reserve the right to remove a sticker or wallpaper early, and to take a sponsor off the site, if (a) your brand, business, product or artwork turns out to be fraudulent, unlawful, materially misrepresented or otherwise something I would not have accepted under section 5, (b) you breach section 8, (c) a court or authority requires it, or (d) I stop using the device. In cases (c) and (d) I refund pro rata as in section 11; in cases (a) and (b) there is no refund.
13. Liability
I am liable without limit for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and for any guarantee I have expressly given. For simple negligence I am liable only for the breach of an obligation whose fulfilment is essential to the contract and on which you may rely (a cardinal obligation), and then only for the foreseeable damage typical of this kind of contract. Any further liability is excluded. This applies equally to my representatives and agents.
14. Your data
How I handle personal data, what is published on the site and how long data is kept is explained in the privacy notice. In short: the bid amount and time of every paid bid are public; your company name, logo and link are public once approved; everything else stays private.
15. Final provisions
- These terms and every contract under them are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
- If you are a merchant (Kaufmann), a legal entity under public law or a special fund under public law, or have no general place of jurisdiction in Germany, the exclusive place of jurisdiction is Frankfurt am Main. The place of performance is Frankfurt am Main.
- The terms in force when you place a bid apply to that bid and to the contract that follows from it. I may change the terms for future bids.
- These terms exist in English only; German legal terms in brackets are given for orientation.
- If a provision of these terms is or becomes invalid, the rest remains in force.
